FOR THE CONSTRUCTION, CONNECTION, OPERATION AND MAINTENANCE OF PIPELINE FACILITIES ON THE INTERNATIONAL BORDER IN PHILLIPS COUNTY, MONTANA, BETWEEN THE UNITED STATES AND CANADA

By virtue of the authority vested in me as President of the United States of America, I hereby grant this Presidential Authorization, subject to the terms and conditions set forth herein, to Bridger Pipeline Expansion LLC (the “Awardee”). The Company is a private limited liability company organized under the laws of the State of Wyoming and is a wholly owned subsidiary of Bridger Pipeline LLC.
Authorization is hereby granted to the grantee to construct, connect, operate and maintain a cross-border pipeline facility, as described herein, at the international boundary of the United States and Canada, in Phillips County, Montana, for the transportation between the two countries of crude oil and petroleum products of all kinds, refined or not (including, but not limited to, naphtha, liquefied petroleum gas, natural gas liquids, jet fuel, gasoline, kerosene and diesel fuel), excluding natural gas subject to section 3 of the Natural Gas Act.
This permit does not affect the application of other relevant laws and regulations. Border facilities are subject to all applicable laws and regulations.
The term “Facilities” refers to the portion of the international pipeline within the United States, as well as any related land, structures, equipment or infrastructure.
The term “Border Facilities” refers to a 36-inch diameter pipeline extending from the U.S.–Canada border to the first shut-off valve or pumping station within the U.S. at a distance of less than 2.000 feet.
LICENSE TERMS
Article 1
Border facilities are subject to all terms of the permit. No substantial changes are permitted without the approval of the President.
Article 2
Facilities are subject to inspection by federal, state and local authorities. The licensee is required to allow full access. Facilities must comply with all pipeline safety laws.
Article 3
In the event of expiration or revocation of the permit, the beneficiary is required to remove the facilities at his own expense. Failure to comply may result in the government taking action against him.
Article 4
In the event of national security, the US may take control of the facilities. Fair compensation will be paid to the beneficiary.
Article 5
Any change of ownership or control must be immediately notified to the President.
Article 6
The beneficiary:
- is responsible for permits and rights of way
- indemnifies the state for any liability
- ensures the good condition and safety of the facilities
Article 7
He is required to submit reports and statements in accordance with American law.
Article 8
He is obliged to provide information to the President upon request.
Article 9
The license does not create legal rights against the United States.
