PROTECTION OF AMERICAN CITIZENSHIP AND AN END TO “BIRTH TOURISM”
Today, President Donald J. Trump signed two Executive Orders aimed at continuing to protect the meaning and value of American citizenship following the decision in the case Trump v.Barbara.
The first Executive Order identifies, but is not limited to, certain categories of children of aliens who are not automatically entitled to U.S. citizenship by birth, in accordance with historically recognized exceptions to the principle of citizenship by birth, as recognized by the Supreme Court in the Barbara case.
The second Executive Order transfers presidential powers to the Secretary of State and the Secretary of Homeland Security and directs them to put an end to the practice of so-called "birth tourism."
PROTECTING THE VALUE OF AMERICAN CITIZENSHIP
President Trump considers the privilege of United States citizenship to be a priceless and profound gift.
American citizenship embodies a sacred bond between the American people and the Nation and comes with important rights, privileges, and responsibilities.
On June 30, 2026, the Supreme Court ruled on the case Trump v.Barbara that the Constitution extends the privilege of citizenship to children born to parents in the United States "to whom no extraterritorial legal exception applies."
Following the Supreme Court's decision in Barbara, the government continues to protect the country from attempts to acquire citizenship by malicious foreign actors and other categories of foreigners, whom the Supreme Court has recognized as not entitled to citizenship by birth based on historically recognized exceptions.
The government, according to the announcement, is protecting the integrity of the country's immigration system by denying entry to people who travel to the United States for the purpose of giving birth there, a practice known as "birth tourism."
According to the White House, these individuals often collaborate with illegal or malicious networks to circumvent immigration laws and plan to exploit their temporary entry into the country so that their children can obtain American citizenship.
"AMERICANS FIRST" AND RESTORATION OF THE IMMIGRATION SYSTEM
President Trump, according to the White House, has delivered on his commitment to fix the immigration system, prioritize American citizens, and protect American citizenship.
In the first week of his return to the presidency, President Trump signed an Executive Order declaring a state of emergency at the southern border and taking immediate action to end what the administration describes as unprecedented illegal immigration during the Biden administration.
According to the information note:
- For 15 consecutive months, no irregular migrants have been released inside the country.
- The Trump administration has launched an unprecedented campaign to strip citizenship from people who obtained it fraudulently.
- To date, the government has initiated proceedings against 88 individuals who acquired American citizenship but allegedly did not meet the legal requirements.
- The Trump administration has deported more than 3 million illegal immigrants, including thousands of people convicted of violent crimes.
- Visa programs and related controls were strengthened, while the processing of visa applications for 75 countries classified as high-risk was suspended, with the aim of protecting national security and limiting overstays.
- Taxpayer-funded benefits were cut for more than 1,4 million undocumented immigrants, who, according to the government, were receiving public assistance unduly.
- Undocumented immigrants were excluded from more than a dozen taxpayer-funded health care programs.
- The government has reformed the naturalization test to better assess applicants' knowledge of American history, politics, and values, as well as to ensure that they meet all required requirements.
- The government has moved to remove tens of thousands of illegal immigrants from state voter rolls and is working to ensure that they will not be able to vote in American elections, a right that, as noted, is protected exclusively for American citizens.
