PREVENTING A MOSAIC OF REGULATIONS ON ARTIFICIAL INTELLIGENCE:
Today, President Donald J. Trump signed an Executive Order to protect American innovation in Artificial Intelligence from an inconsistent and costly compliance regime resulting from different state laws.
The Decree instructs the Minister of Justice to establish a AI Litigation Task Force, which will challenge state AI laws that are unconstitutional, overturned by higher law, or otherwise illegal and that harm innovation.
The Order directs the Secretary of Commerce to publish an assessment of state AI laws that conflict with national AI policy priorities and to do not grant BEAD (Broadband Equity Access and Deployment) funding to any State with such AI laws. Other federal agencies are directed to consider whether to make the absence of such laws—or a policy of discriminatory enforcement of existing such laws—a condition for their respective discretionary grant programs.
The Order directs the Federal Trade Commission (FTC) and the Federal Communications Commission (FCC) to take steps to limit the ability of States to compel AI companies to mislead consumers, including examining whether laws requiring companies to incorporate DEI (Diversity, Equity, Inclusion) into their models would place those companies in violation of the Federal Trade Commission Act, and considering whether to adopt a federal reporting and disclosure standard for AI models.
The Decree calls for the development of a national legislative framework for AI, which will override state AI laws that hinder innovation.
ENHANCING AMERICAN COMPETITIVENESS:
President Trump is acting decisively so that our great technological pioneers can compete on the international stage, ensuring America's national security and economic prosperity in the age of AI.
State legislatures have introduced over 1.000 different AI bills, creating a mosaic of rules, disclosure obligations, and reporting requirements.
States like California and Colorado are considering requiring AI companies to censor their results and incorporate left-wing ideology into their programming.
Reducing compliance costs and development burdens associated with different state laws will lower barriers to entry in the AI sector and boost innovation, ensuring that American companies are not subject to restrictions that their international competitors do not face.
The most restrictive states they should not be able to dictate national policy on AI at the expense of America's dominance in this new field.
ESTABLISHING AN AI POLICY BASED ON COMMON LOGIC:
The Trump administration supports an approach common sense in AI policy. This means removing unnecessary bureaucratic obstacles, updating outdated rules created before AI developments, and clarifying new rules for specific sectors or use cases.
President Trump stated:
“Investment in AI is helping to make the US economy the “HOTTEST” in the world, but overregulation by states threatens to undermine this Great Growth Engine. Some states are even trying to incorporate DEI ideology into their AI models, producing “Woke AI” (remember “black George Washington”). We MUST have a federal standard instead of a patchwork of 50 different state regulatory regimes. If we don’t, then China will easily overtake us in the AI race.”
The Trump Administration is committed to protecting the dignity, privacy, and safety of children in the digital age. In May 2025, President Trump signed the Act into law Take It Down Act, a legislation promoted by the First Lady to protect young Americans from exploitation through deepfakes online.
The Order builds on President Trump’s history of promoting AI models that pursue truth and accuracy. In July 2025, he signed an Executive Order that prevents the federal government from using AI models that include ideological biases or social agendas.
Today's Executive Order implements the AI Action Plan President Trump's plan, presented in July 2025, called for a review and removal of overly burdensome regulations that hinder America's ability to lead in this critical technology.
