Judges who do not speak up when fundamental principles of the state are violated are complicit
The proverb "Silence is gold" was used by many ancient writers, and Menander even focused on women: "Women throughout the world silence brings" (for all women silence is an ornament), thus expressing the then known degraded position of women in Athenian society. Over the years, however, both the conditions for women and the use of the proverb for certain sectors, including Δικαιοσύνη.
The democratic system presupposes a justice system close to the citizen, and servants of Themis, who will have freedom of speech. I read that recently the Strasbourg Court moved in exactly this spirit and vindicated a Romanian judge, who had been punished for publicly expressing his opposition to government policy, which questioned the rule of law. However, according to this court, judges have the right to speak out when they perceive that this is threatened.
She is Romanian too European Prosecutor Laura Kovesi, who, while receiving the highest honor of the French Republic for her great dedication and exceptional courage in the fight against corruption and for her contribution to civil society, received threats and suffered unacceptable persecution during the course of her duties. In Greece, in fact, during the sad period of corruption, while society recognized the qualities for which L. Kövesi was distinguished, she not only faced the obstruction of carrying out the control she sought, but also received the discrediting of her work by many rulers. These unacceptable reactions are due to the fact that the European Prosecutor repeatedly mentioned on the need to change article 86 of the Constitution, who obstructed her investigation into OPEKEPE, about which she specifically said that it had become the acronym for corruption!
She, moreover, had stated that the Tempi tragedy could have been avoided if the railway projects had been implemented on time and correctly, however, corruption and financial crime can kill, and Tempi is a prime example of this reality.
The tragedy of Tempi and its scandals OKAY are outrageous phenomena for our country. The willingness to conceal evidence for the necessary investigation and the administration of justice, the bypassing of preliminary examination, as well as the humiliation of the parliamentary process with mass postal votes in order not to form a preliminary examination committee, the delay in justice and the statute of limitations on many cases, have now convinced citizens of the involvement of state actors.
Today in our country, and not only, the justification decided by the Strasbourg Court, acquires particular weight as the crisis of the institutions and the violation of the law is obvious. Judges who do not speak up when fundamental principles of the state are violated are complicit. Silence is not always golden!
